10年前筆者有幸參加2010年年初財團法人新世紀基金會在北投舉辦的「WTO國際經貿法菁英訓練團」，講義一直不丟的原因，就是因為其中內容相當豐富且扎實。其中又以本次要介紹的是鄧振中（時任國安會副秘書長）分享「從日內瓦WTO人才養成」，及教大家怎麼在國際會議中講的頭頭是道的一篇文章最讓筆者愛不釋手。本次將節錄演講相關重點及實用的英文演講稿。

一、WTO的功能

1.談判

●類似國內體制上的立法功能

●談判的目的在於制定新的國際規範或修改現行的國際規範

●1995年時烏拉圭回合談判的結果生效，WTO開始對農業，服務業財產權等議題有了新的規範，也同意對紡織品貿易的限制加以廢除

2.確保各國履行其承諾並遵守各項協定

●類似國內體制上的行政功能

●方法係經過其所設立的各個理事會或委員會，來要求各會員國自行提報法規、資料，以便各會員國檢視，提問或講重話來確保各會員均能確實履行其義務。

●能不能達到預期效果？

3.爭端解決

●類似國內體制上的司法功能

●需要很高度的訴訟技巧，方法上也與西方式的訴訟程序很類似。

●仍以大國的使用情形比較多，正義的最後一道防線，小國開始使用

●戰略上忽視，戰術上重視

二，各國代表的任務

1.表達並爭取各自政府的立場

●一般而言，代表的發言就代表他政府的立場，雖然有些時候，有些代表會強調他尚未獲得授權作某些陳述，然而一旦說出口，就具有某種意義

●會議很多，議題的內容十分廣泛，小國代表團人少，無法參與所有會議，就算人手多的代表團，有時也會有準備不及，走進會場時，仍然不知道會議討論重點何在的現象，怎麼辦？

●意見表達完成後，與會代表的任務完成了沒有？假如沒有人反對是否即代表你的論點已有共識，因此可成爲會議結論的一部份？

2.打聽消息，蒐集資訊

●爲使自己的政府握有充分的資訊以便作出最好的判斷，各國代表必須耳聰目明，關係良好，否則打聽不到消息

●獲得的資料如何判斷其真假，亦是一個問題，不能不負責任，將所有的消息都報給國內，讓國內作判斷。

3.爭取盟國，打擊對手

●各國均有不同利益，假如沒有妥善安排，只在會場做些陳述，到時候隨便幾個人講幾句負面的話，就沒有成功的機會，所以事先要知道可能支持你的立場的有哪些國家，會反對你的立場的有哪些國定。經過必要的安排後，才能確保會議成果對你有利。

4.廣結善緣，發揮影響力

●假如各國代表均需要爲自己的政府爭取最大利益，必要時又要公開反對別國代表立場，有沒有可能廣結善緣？

●許多國家派駐WTO之人員均爲一時之選，調回國後，很可能位居要津。如何耕転善加利用這些關係，亦爲重要任務。

●倘能對某項議題成爲意見領袖，將對談判結果具有相當的影響力。怎麼樣才能成爲意見領袖？

三，各國代表會面對的難題

1.會議太多，無法兼顧

2.資料數量太大，讀不完

3.要和你非常不喜歡的人結盟，或者需與非常喜歡的人為敵。

4.社交活動太多，與你偏好的安靜的個性不合

5.國內給的立場與WTO的規範不合，難以執行

四，WTO規範之原則及例外

1.最惠國待遇原則

2.國民待遇原則

3.關稅減讓應受拘束原則

4.不得設立數量限制原則

五，經由WTO體制維護本因企業利益方式

1.先研究外國政府的作為有沒有違反WTO規範或這個國家過去所作的承諾

2.經由本國政府向外國政府提出問題或要求諮商如果對方相應不理

3.藉由WTO各相關委員會會議時，請各國作輿論譴責。仍然不理，怎麼辦？

4.提起訴訟（爭端解決）。

六，WTO中可以自由替換演講稿

據說是某國外律師的大作，把各節做不同的替換，可以講很長卻又什麼都沒有講。這可是經典呀，一定要好好記起來！

Recent developments in trade policy clearly show	A full implementation of the objectives stated in the Ministerial Declaration	Requires that substantial progress is also reached in other areas which are essential for	Assuring more stability in the field of trade and finance
My delegation is from the opinion	A long-term solution to the proliferation of grey- area measures	Should be given a proper place in negotiations dirccted at	Avoiding the constant deterioration of the trading environment
Neither should we forget that	A balance attempt at solving the issue of safeguards	Constitues a sine qua non for	Resolving the curent tensions in the trading system

Combine any phrase from Column I with any phrase in Column II, III and IV and you will obtain a universal GATT statement. The number of possible combinations is 10,000.You will be able to speak for about 40 hours.
